These Terms of Service (“Terms”) govern your access to and use of pixstick.shop (the “Site”) and any products or services offered by PixStick (“PixStick,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority in your state, to place an order on this Site. By using the Site, you represent that you meet this requirement.
2. Products & Orders
• All products are custom-made to order using photos and content you provide.
• Product descriptions, images, and pricing are subject to change without notice.
• We reserve the right to limit quantities, refuse, or cancel any order at our sole discretion — including for suspected fraud, pricing errors, or content that violates these Terms — whether or not the order has been confirmed.
• If we cancel an order after payment has been collected, you will receive a full refund.
3. Photo Uploads & Content
When you upload a photo or other content to PixStick for use in a custom product, you agree to the following:
• You own the rights to, or have permission to use, every photo or image you upload.
• You will not upload content that is copyrighted by a third party without authorization, sexually explicit, violent, hateful, illegal, or otherwise inappropriate.
• You grant PixStick a limited license to reproduce, print, and process your uploaded content solely for the purpose of fulfilling your order.
• You are solely responsible for the content you upload. PixStick is not responsible for verifying ownership or rights to submitted images.
PixStick reserves the right to refuse to print, and to cancel, any order containing content that violates these Terms, at our sole discretion and without prior notice.
4. Pricing & Payment
• All prices are listed in U.S. dollars and are subject to change without notice.
• Payment is due in full at the time of order.
• We use third-party payment processors to handle transactions; PixStick does not store your full payment card information.
• In the event of a pricing error on the Site, we reserve the right to cancel the affected order and issue a full refund.
5. Shipping & Returns
Shipping timelines and costs are described in our Shipping Policy. Returns, refunds, and replacements are handled according to our Refund & Returns Policy. Both policies are incorporated into these Terms by reference and available at pixstick.shop.
6. Intellectual Property
All content on the Site — including but not limited to the PixStick name, logo, graphics, text, layout, and design (excluding customer-uploaded photos) — is the property of PixStick and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission.
7. Prohibited Conduct
When using the Site, you agree not to:
• Violate any applicable law or regulation.
• Upload or transmit viruses, malware, or other harmful code.
• Attempt to gain unauthorized access to the Site, our systems, or other users' accounts.
• Use the Site for any fraudulent or unlawful purpose.
• Scrape, harvest, or collect information from the Site without our consent.
8. Third-Party Links & Services
The Site may contain links to third-party websites or use third-party services (such as payment processors or shipping carriers). PixStick is not responsible for the content, policies, or practices of any third-party site or service.
9. Disclaimer of Warranties
The Site and all products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the fullest extent permitted by law, PixStick shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products, including but not limited to loss of data, loss of profits, or damages resulting from shipping delays, third-party carrier issues, or content you upload. Our total liability for any claim related to your order shall not exceed the amount you paid for that order.
11. Indemnification
You agree to indemnify and hold harmless PixStick, its owners, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Site, your violation of these Terms, or your violation of any third party's rights (including intellectual property rights) in connection with content you upload.
12. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Colorado.
